Service Agreement
This agreement outlines the terms and conditions between VanillaSkyFilms and the client for the provision of aerial drone photography and videography services. By engaging VanillaSkyFilms, the client agrees to the terms below:
1. Commitment to the Project
A $110 payment must be made before work begins. This payment ensures your commitment to the project and enables us to schedule and prepare for your shoot (Airspace Research, Airspace Authorization, Drone Preparation, Time Planning).
Any changes to the scope of the project after work has commenced may incur additional charges, which will be discussed and agreed upon prior to implementation.
2. Permissions and Content Release
Upon receipt of full payment, VanillaSkyFilms will provide the client with a download link to access the original content. The link will be shared via email.
It is the client’s responsibility to download and back up the provided content within 30 days, as VanillaSkyFilms cannot guarantee indefinite storage.
3. Client Responsibilities
The client must secure all necessary authorizations required for aerial photography or videography at the project location (example: gated community access or permission to take off from a private property)
VanillaSkyFilms will not be held responsible for delays or cancellations due to the lack of proper permissions.
4. Liability
The client agrees that VanillaSkyFilms and its representatives, including Girts Avotins, will not be held liable for any damages, injuries, or losses incurred during or after the execution of the project.
VanillaSkyFilms is not responsible for any adverse weather conditions, or unforeseen events that may impact the delivery timeline.
5. Intellectual Property and Usage Rights
Upon full payment, the client receives the right to use the delivered content for personal or commercial purposes.
VanillaSkyFilms retains the right to use the material for editorial, promotional, or portfolio purposes. This includes, but is not limited to, showcasing the work on the VanillaSkyFilms website, social media channels, or during client presentations.
6. Cancellation and Rescheduling
Cancellations made by the client less than 48 hours before the scheduled project date will result in a forfeiture of the initial payment.
Rescheduling due to weather conditions or other unforeseen events will be accommodated at no additional cost, subject to availability.
7. Governing Law
Any disputes arising from this agreement shall be resolved directly between VanillaSkyFilms and the client, without involving legal proceedings or third parties.
